ORDER
THIS CAUSE having come on to be heard upon the Motion To
Dismiss filed by the Defendant, WINDMILL POINT II, and the Court
having heard arguments of counsel and otherwise having been advised
in the premises, it is
~ ORDERED AND ADJUDGED that Count II of the Complaint concerning
punitive damages is hereby striken with leave granted to the Plaintiff
to amend the claim for punitive damages at such time as the necessary
facts are discovered, it is further
ORDERED AND ADJUDGED that the Defendant, WINDMILL POINT II,
shall file its responsive pleadings to the Complaint within twenty
(20) days of the date of this Order.
