6, Payments deducted pursuant to this Order shall continue u~til
fvrther order o£ the Court or Notice fram the DEPAI~Il~NT OF HFALZIi AND
RF.k~BILITATIVE SERVICES.
7. Payme~rits received by the Clerk of this Court shall be disbursed
pursuant to the child su~port order in force and effect in this case.
8. Any employer which censes to emplay or pay the obligor, shall notify
the Depart~menC of Health and Rehabilitative Services and shall also pravide the
obligor's last lmawn address and the hane and address of obligors reew em~loyer~ if
l~own. Failure to pravide such infonmation may subject the es~layer to the civil
penalties set forth iri Paragraph 9 belvw.
9. It is unlawful for an emQloyer to discharge, refuse ~o employ, or
~ take disciplinary actian against an emplayee because of an Income Deductian Order.
If such activn is taken ~ the eraployer may be sub j ect to a civil penalty not to
exceed $250.00 for the first violatio~ and $500.00 for each subsequent violativn.
Additivnally, the emQloyer may be ca~elled by a caurt of coanpetent 3urisdiction
to rehire the employee and pay that e~loyee all back wages and benefits lost,
plus reasonable attorney fQes and court costs.
10. If the es~layer fails to deduct and pay the aQro~ait ordered by this ~
caurt for child supporC paya~.mts ~ it may be liable for the ~rnmt that shauld have
been deducted ~d paid, plus reasonable attorney fees, caurt costs and interest.
11. If an ~layer receives Incane Deductian Orders for two or more
e~loyees requiring that payments be made to the Clerk of the Circuit Court of the
s~ne county, the emQloyer may combine the payn~ents in a single check plus a praper
; accrnmtir~g of the amcn.mts attributable to each emplayee. In tt~ event mare than
one Income Deductian Order is received for an obligor~ you stiall contact the coure
for further instructians.
12. The e~loyer may collect aver and abwe the sup~~ort deductian, up to
$5.00 for adninistrative costs for the first income deducCion payment for an
e~layee and $1.00 for each subsequent incane deductian payment.
13. Zhe e~loyer,shall begin making deduction na later than f~teen
(lb) days after receipt of this notice. Each pay~rent shall be forwarded to the
Central Gaverr~ntal DepositoY}? within tt,ao (2) days of obligors payday.
14. This order has priority over all otttier legal processes imder state
law. Payment required by this order is a complete defense against any claims of
the obligee or his/her creditors as to the sun paid. ~
~ 15. Ttiis Inccxre Deduction Order shall replace and supercede any prior ~
wage dQduction order or voluntary wage assigrnrent. ~ ~
