(individua~ or corporate) for such purposes as dealing with
assets outside Califorr?ia. A Special Trustee shall h~ve
only those powers which are necessary as enumeratecl herefn
or otherwise permitted hy law. The Tcustee shall exercise
his discretion in compensatfng a Special Trustee and
aetermining if bond shQuld be required. Expenses of a
Special Trust~e shall be a charge against the trust in
addition to the Trustee's compensation.
e. Physical Division of Trust Property Not Required.
There need be no physical segregation or division of the
various trusts except as segregation or division may be
requfred by the termination of any of the trusts, but the
Trustee shall keep separate accounts for the different
undi~ri~ed interests.
ARTICL~ V
TRUSTEES I~ND SUCCESSOR TRUSTEES
A. Trustors as Trustees. The Trustors shall, during
their joint lifetimes, or until either or both of them die,
become incompetent or resign, serve as Co-Trustees of the
trusts created hereunder.
B. Successor Trustee. Upon the resignation, death or
incompetency of either Ttustor, the other Trustor shall serve
as sole Trustee, provided, however, that he shall have the
right but no obligation to appoint by instrument in writing,
duly acknowledged, a Successor Trustee or Co-Trustee. Any
Successor T~ustee or Co-Trustee shall succeed to all the
powera, discretions, righta and obligations g3.ven to the ~
Co-Trustees first named in this Declaration of Trust. The
surviving Ttustor may remove without cause any Trustee act-
ing under this instrument at any time and substitute any
'i individual Trustee, or corporate Trustee authorized to act -
in the State of California whose capital and surplus exceeds
; Ten Million Dollars ($10,000,000.00). In the event a Succes-
~ sor Trustee or Co-Trustee is not named by the surviving
- Trustor, then upon his resignation or incompetency, and in
any event upon his death, the Successor Tru~tees named below
; shall serve in the order designated, if the prior Trustee
fails to qualify or ceases to act:
