SECTION 1-7.6-38 WAIVER OF MITIGATION PLAN
t
(1) A mitigetion plan shall not be required when the
proposed mangrove alteration or~removal:
(a) is associated with the construction ot a dock, or
a combfnation of docks, less then or equal to five hundred (500)
square fest, including eny part oP a walkMay over wetla~d,
intertidal and open water areas, end
(b) involves no more then ten (10) mangrove trees.
(2) The above waiver of the mitigation plan may only be _
granted once Por the property in question.
SECTION 1-7.6-39 PERMIT APPI.ICATION PROCEOURES FOR SELECTIVE
TRIMMING OR PRUNING
The_following procedures apply to selective Lrim ming or
pruning whiCh is distinct from mangrove alteration or removal:
(1) A person tlesiring to selectively trim or prune
mangroves in unincorporated St. Luc1e County shall apply for e
permit on Porms provided by the Plenning Division, unless the
proposed trimming or pruning is exempt pursuant to Sectlon
. 1-7.6-27 of this ordinance.
(2) An application tee shall aceompany permit applicetions ~
for selective trimming or pruning pursuent to Section 1-7.6-43.
(3) Wfthin a reasonable period oP time ~ot to exceed thirty ~-y
(30) days aPter receipt ot an application or receipt oP additionel
informetion pursuant to tnis section, the Planning Oivision shall
examine the application or in4ormation end notiPy the applicent of ~
. any appase~t errors or omissions, ena request such additional
information as may be necessary for tne processing ot the
~ application.
(4? Within thirty (30) working days after an application
nas been determined to be complete by the Planning Oivision, the
divisi~n shall teke one (1) ot the to~.loMing ections:
(a) Approve the application end issue a permit.
(b) Approve tne application ~nd issue a permit Mith
specitic condition(s) reasonably neeessary to assure complianee ,
