(1) jrear of such action, then $uch action shall co~stitute
alteration without a permit and the permittee shall be sub~ect
to entorcement and pe~alties as set out i~ Section 1-7.6-42. ~
(12) Selective trimming in excess ot what is specified in ~
the permit snall constitute alteration without a permit end the ~
permittee shail be sub~ect to enforcement anti penalties as set out
in Section 1-7.6-42.
(13)A permit shall expire 45 days after issuance.
However, a permit shall not be issued whiCh extentls beyor~d March
31~ of any year.
SECTION 1-7.6-41 PERMIT CUMPLIANCE FOR SELECTIVE TRIM MING OR
, PRUNING
(1) If the P•lanning Oivision cietermines that the photo(s)
taken pursuant to Section 1-7.6-39(5) inciicates non-alteration, an
inspection shall be made approximately one (1) year atter the
. trimming to ensure that d@eth, destruction or other forms of
alteration have not occurred.
(2) If Lhe Planning Ofvision cannot make a determi~ation
from the photo(s), ar~ inspection may be canducted within thirty
(30) days oP receipt of the photo(s). An inspection shall be made
. approximately one (1) year after the trimming to ensure that
death, tlestruCtio~ or other forms oP alteration have not occurred. ~
(3) IP the Planning Division cietermines that tne photo(s)
indicate alteration, an ir~spection shall be made 30 ctays after ~
receipt of the pt~otots). IP the inspection determines that tne ~
trf mming constituteo an alteration without a permit, the Planning i
Oivision shall notity the permittee of such finding, and the
permittee shall be sub~ect to enforcement and penalties as set
out in Section 1-7.6-42.
~ (4) Any final decision of the Planning Oivision on permit
compliance may be appealed to the Board in w.rf ting, addresse~ to
the County Administrator, within tnirty (301 days from the date of
the final decision by the division.
