VAGATING FORECLOSURE SALE AND
ALLOWING RETURN OF ORI~INAL NOTB AND M4RTGAGE
THIS CAUSE came on this day gor considerstion bq the Court upon Plaintiff's
Motion to Vacate Summary Final Judgment of Foreclosure and to Vacate Foreclosure
Sale, and for return to the Plaintiff of the original note and mortgage filed
herein, for its files, and it appearing to the Court that the Mortgagor-Ownera
and Defendants, BILLY D. MITCHEM and CAROLYN S. MITCHEM, his wife, on or about
March 13, 1987, tendered to Plaintiff all sums necessary to reinstate and bring
current the mortgage loan which is the sub~ect vf this cause; that the Plaintiff
allowed such reinstatement of said mortgage Ioan, and that it is necessary that
the original note and mortgage now filed in this cause be returned to the files
of the Plaintiff Association in order to satisfy Federal regulations, substitute
photocopies having been attached to Plaintiff's motion, and the Court being
fully advised in the premises, it is hereby
ORDERED AND ADJUDGED that the Suarmary Final Judgtcent of Foreclasure filed
herein on Februsry 2, 1987, be, and the same is hereby vacated as if never
entered in this cause. It is further
ORDERED AND ADJUDGED that the original note and mortgage now filed herein

be restored to full force and effect, and returned to the Plaintiff, HARBOR
' FEDERAI. SAVINGS AND LOAN ASSOCIATION, to be retained in its files pursuant to
