! The Defendant, THE PHOENIX INSURANCE COMPANY, makes and

~ serves this its Answer in response to that certain Complaint
~ herein and for cause says as follows: =
1. It is admitted that Plaintiffs suffered a casualty
loss on or about the time alleged;
2. It is admitted that a policy of insurance existed -
between and amoung the parties hereto, the terms and conditions ~
of said policy speaking for themselves and being the best
evidence thereof;
~ 3. Defendant admits that it is aware of the nature of :
Plaintiffs' claim for damages and asserts no specific policy ,
language in response thereto and, in fact, specifically admits
that there is coverage under the policy herein sued upon for the
losses claimed by Plaintiffs, the only dispute between and amoung
the parties hereto being over -ihe extent of the damages actually
sustained by Plaintiffs as a consequence of the episode giving
rise to such damages.
~ 4lHEREFORE Defendant denies that Plaintiffs are entitled
to a recovery in excess of the amount previously offered to
Plaintiffs and request costs.
