Defendant. / j: ~ ~ FINAL JUDGMENT ; t This cause Goming on for trial before the court and on the ~ evidence presented the court makes the following findings of fact and conclusions of law. The decedent, Eleanor Strader, was a 60 year old woman living in Fort Pierce, Florida at the time of her death in November of 1983. This case begins approximately a year prior to that time when the decedent was married to her husband Keith Strader. At that time Mr. and Mrs. Strader separated and obtained a divorce. As part of the property settlement and disposition 'i of the divorce, Mrs. Strader received a mortgage generated from the i sale of their home. This was to be the sole means of her support 4 ~ for the remainder of her life. The approximate value of the ~ mortgage was some $70,000.00 with regularly monthly payments of ~ approximately $700.00. At the time of the divorce Eleanor Strader was an alcoholic, was extremely lonely, and despondent. Although she had a daughter, the administrator ad litem herein, her daughter lived in North Carolina and not available to help her mother at the time. During the divorce proceedings and subsequent thereto, she consulted her pastor, the defendant herein, Nevi Townsend. The pastor is the ' minister of Parkview Baptist Church and Mrs. Strader was a member of the congregation, living only 200 feet from the church.
