Subsequent to the execution of the document, Mrs. Strader
applied for welfare benefits to cover her hospitalization and
subsequent nursing care. However, on the benefit application,
the mortgage was listed as "unearned income". There was no
information given regarding the transfer of the mortgage to
Reverend Townsend. After inquiring into the mortgage, H.R.S.
sent a letter to Reverend Townsend requesting him to return the
mortgage to Mrs. Strader or to have her apply for other social
security administration benefits. Reverend Townsend at that
time advised H.R.S. that he could apply $500.00'of the mortgage
payment each month to Mrs. Strader's bills.
On the day of Mrs. Strader's discharge from the hospital, the

; accountants at Lawnwood came to see Mrs. Strader with regard to
~ her bill which she had incurred at the hospital. At that time
Mrs. Strader asked the collection accountant, Eva Bresson, to
~ contact Reverend Townsend because he knew more about her ~
financial affairs than she did. Nevertheless, at that same time
when Mrs. Bresson contacted Reverend Townsend, he told her that
he did not know why Mrs. Strader had told her to contact him.
When Mrs. Bresson asked about other family, he advised her at
that time that Mrs. Strader's daughter was out of town and hadn't
seen or corresponded with her in years, even though at that time
Mrs. Ezell had just arrived in town, having been notified of her
mother's illness only a few days before.
On behalf of the Defendant, the chairman of the hoard of
deacons, John Trout, testified that he visited Mrs. Strader in the
nursing home subsequent to, her discharge from the hospital. He
~ testified that she told him that she had given the mortgage to "
Reverend Townsend and had appreciated what he had done for her. 3
Nevertheless, in August, she contacted her attorney's office to
revise her will. At that time an assistant from the attorney's
`k' office went to visit her and recorded a memo to the file which

indicated the various provisions which Mrs. Strader had in
the will. The assistant recorded that there was no need for '
a further provision for the church in the new will because Mrs.
Strader had already taken care of that.

In October a new will was executed through attorney Bryan's 1
