THIS CAUSE coming on for trial without a jur`y before this
Court on May 14, 1987, and the Defendant, FRANCIS T. RYAN, having
failed to appear or be present at trial, and this Court having
- heard the testimony of the witnesses, having reviewed the docu-
ments acimitted into evidence, having heard the argument of
counsel and being otherwise fully informed and advised in the
premises herein, it is hereby
' ORDERED AND ADJUDGED as follows:
1. Those Aff irmative Defenses raised by Defendant, FRANCIS
T. RYAN, are hereby stricken, without prejudice, based upon his
failure to appear at trial and his failure to notify the Court as
j to any potential conflicts or time schedule diff iculties until
immediately prior to the commencement of the trial.
The Court finds that the Affirmative Dsfenses raised by
Defendant, FRANCIS T. RYAN, are not co.npulsory counterclaims to
the Plaintiff's Complaint and that, should he desire to pursue
these claims, he may due so through the filing of a separate
lawsuit.
2. Final Judgment is entered in favor of Plaintiff, WORLD
OF PLASTICS, INC., and against Defendant, FRANCIS T. RYAN, on the
Complaint of Plaintiff in the amount of $18,438.76, being the
amount of principal and interest due under the promissory note
sued upon herein, and f or the additional amounts of $481.00 as
reasonable and necessary Court costs, and $4,275.00 as reasonable
attorney's fees of Plaintiff's counsel herein, resulting in a
