ORDER TO DISMISS FOR FAILURE TO PROSECUTE
THIS MATTER came before the Court upon the Counter-Petitioner's
motion to dismiss the Petitioner's sworn petition for adoption for failure
to prosecute pursuant to Florida Rule of Civil Procedure 1.420(e). Present
at the hearing were Margaret F, Zehren, Esq., Florida Rural Legal Services, Inc.
on behalf of Counter-Petitioner, Julia Townsend, and Petitioner, Johnnie Mae
Franklin, and the natural mother, Eula Dixon. The Court has examined the
pleadings and being otherwise fully advised in the premises, it is there-
upon
ORDERED AND ADJUDGED:
1. The motion to dismiss the Petitioner's sworn petition for
adoption for failure to prosecute pursuant to Florida Rule of Civil Pro-
cedure 1.420(e) is granted.
2. The Counter-Petitioner's sworn counter-petition for adoption
is voluntarily dismissed without pre3udice pursuant to Florida Rule of Civil
Procedure 1.420(a)(1)(i).
