Assignmeat ot Rent~ Appoinhnent of Receiver. As additional security hcreunder, Borrowen c~reby assigns to Lender the rents of the Property, provided that Borrower shall, prior to aoceleration under paragraph l7 hereof or abandonment Qf the Property, havc the right to oollect and retain such rents as they beoome due and payable. Upon aoceleration under paragraph l7 hereof or abandonment of the Prcperty, I.endcr shall be entitled to have a receiver appointed by a court to enter upon, take possession of and manage the Property and to oollect the rents of the Property i~cluding those past due. All rents coliecte~ by the receiver shall be applied Crst to p~yment of the oosts o! management ~ of the Property and oolloction of rents, inciuding, but not limited to, receiver's fces, prcmiums on receiver's bonc~s ar~d neasonable attorneys' fces, and then to the sums secured by this Mortgage. The receiver shall be liable to aca~unt only for those rents actuaUy received. 20. Release. Upon payment of all sums secured by this Mortgage, I.ender shall release this Mortgage without charge to Borrower. Borrower shall pay all oosts of recordation, if any. Zl. Attoraeys' Fees. As used in this Mortgage and in the Note, "attorneys' fees" shall include attorneys' fees, if any, whieh may be a~varded by an appellate court. REQUEST FOR NOTICE OF DEFAUGT AND FORECLOSURE UNDER SUPERIOR MORTGAGES OR DEEDS OF TRUST Borrower and Lender request the hokler of any mortgage, deed of trust or other encumbrance with a lien which has priority over this Mortgage to give Notice to Lender, at I.,ender's address set~forth on page one of this Mortgage, of any default under the superior encumbrance and of any sale or other foreclosure action.
