PETITION FOR REMOVAL OF PERSONAL REPRESENTATIVE
AND
APPOINTMENT OF SUCCESSOR PERSONAL REPRESENTATIVE
Petitioner, AUDREY BUGILONE, alleges:
1. Aespondent, KENNETH G. SERVIO was appointed
Personal Representative of the Estate of LUCILLE SERVIO,
Deceased by this Court on February 10, 1982, and is Personal
Representative at this time.
2. Petitioner is the daughter of the Decedent and
~ a Beneficiary of the Estate.
3. Petitioner, AUDREY BUGLIONE, resides at 990
Barrie Avenue, Wantagh, NY 11793.
4. Respondent should be removed as Personal Repre-
sentative and his Let~ers of Administration should be revoked
for the following reasons:
a. Respondent has not filed the required Federal
Income Tax Returns for the Estate as required
by Federal Law;
; b. Respondent has not taken steps to file an a.ccount-
ing during his term as Personal Representative of~
the Estate or otherwise keep Petitioner apprised
of tbe Estate:
c. Respondent does not return telephone calls made
by Petitioner in attempts to inquire as to the
status of the Estate;
.
d. The former attorney for Respondent with respect
to the Fstate withdrew as Counsel due to the
lack of diligence on behalf of Respondent~ in
performing his duties as Persooal Representative
of the Estate; and, _
e. Respondent has failed to secure the services of
legal counsel on behalf of the Estate since the
withdrawal of James P. Beadle, Esquire.
