6. Paymen~ deducted pursuant to this Order shall _
continue until further order of the Court.
7. Payments received by the Clerk of this Court
shall be disbursed pursuant to the child support and/or alimony
order in force and effect in this case. ~
8. Any employer which ceases to employ or pay the
Obligor, shall notify the Clerk of this Court and all parties
to this action and shall also provide the Obligor's last known
address and the home and address of Obligor's new employer, if
known. Failure to provide such information may subject the
employer to the civil penalties set forth in Paragraph 9 below.
~ 9. It is unlawful for an employer to discharge,
refuse to employ, or take disciplinary action aqainst an
employee because of an Income Deductio~ Order. If such action
is taken, the employer may be subject to a civil penalty not to
exceed $258.00 for the first violation and $500.00 for each
subseguent violation. Additionally, the ~mployer may be
compelled by a Court of competent jurisdiction to rehire the
employee and pay that employee all back wages and benefits
lost, plus reasonable attorney's fees and Court costs.
10. If the employer fails to deduct and pay the
amount orc3ered by this Cour~ £or child support and/or alimony
payments, it may be liable for the amount that should have been
deducted and paid, plus reasonable attorney's fees, Court costs
and interE~st.
11. If an employer receives Income Deductian Orders
: for two or more employees requiring that payment be made to the
Clerk of the Circuit Court of the same Gounty, the employer may
combine the payments in a single check plus a proper accounting
of the amounts attributable to each employee. In the event
more than one Income Deduction Order is received for an
' Obligor, you shall contact the.Court for further instructions.
. 12. The employer may collect over and above the
' support deduction, up to $5.00 for administrative costs for the
. first income deduction payment for an employee and $1.00 for
each subsequent income deduction payment.
13. The en?ployer sha1Z begin making deduction no
; later than fourteen (14) days after receipt of this Notice.
= Each payment shall. be forwarded to the Central Governmental
~ Depository within two (2) days of Obligor's•payday.
14. . This Order has priority over all other legal
processes under state law. Payment required by this Order is a
complete defense against any claims of the Obligee or his/her
creditors as to the sum paid.
~ 15. This Income Deduction Order shall replace and
~ supercede any prior wage deduction order or voluntary wage
~ assignment.
