t SECTION 1-Z0.5-7. Sale, assignment, or transfer of certificate,
facilities, or control. '
(a) No utility shall sell, assiqn, or transfer its
certificate, facilities, or any portion thereof, or ma~ority
. organizational control without determinat3on and approval of the
Authority that the proposed sa].e, assignment, .or transfer is in

the public interest.

; (b) An application for proposed sale, assignment, or

transfer shall be accompanied by a fee as es~ablished from time
to time by the Hoard. No fee is requirea to be paid by a
governmental agency that is the buyer, assignee, or transferee.
(cj An application shall be disposed of as provided in
Section 1-20.5-4 except that:

' (1) The sale or transfer of a certificate or facilities

~ to a governmental agency shall be approved a~ a matter of right;
hawever, the governmentai agency sha12, prior to taking any
official action, obtain from the Authority with respect to the
authority or facilities to be sold or transferred the most recent
i available income and expense statement, balance sheet, and
statement of rate base for regulatory purposes, and
- contributions-in-aid-of-construction.
