its final order within 8 months of the receipt of the completed
application.
SECTION 1-20.5-9. Interim Rates.
(a) The Authority may, during any proce~eding for a change of
rates, upon its own motion, or petition from any party, authorize
the collection of interim rates until the effective date of the
final order. Such interim rates may be based upon a test period
differe~t from the test period used in the request for permanent
rate relief. To establish a prima facie entitlement for interim
relief, the Authority, the petitioning party, or the utilty,
~ shall demonstrate that the utility is earning outside the range
of reasonableness on rate of return caiculated in accordance with
~ subsection (d}.
{1) In a proceeding for an interim increase in rates~
the Authority shall authorize, within 60 days of the
filing for such r~lief the callection of rates
sufficient to earn a rate of return at the minimum of
the range of the last authorized rate of return. The
difference between the interim rates and the previously
authorized rates shall be collected unde= bond or
corporate undertaking sub~ect to refund with interest at
a rate ordered by the Authority.
(2) In a proceeding for a interim decrease in rates,
the Authority shall authorize, within 60 days of the
filing for such relief, the continued collection of the
