impairing its capacity to serve its existinq customers. Any
utility which provides service for resale shall provide such
service upon terms and conditions established by the Authority,
and no utility ahall discontinue such service without the
approval of the Authority. In the event a governmental aqency
voluntarily enters into an agreement for resale, such agreement
shall provide that the service will not be discontinued without
90 days notice taeing g3ven to the purchaser prior to
discontinufng such service. Nothing contained herein shall be
construed to p~ohibit the governmental ac~ency from requiring
adequate security be given to such agency to ensure payments
required in the agreement.
SECTION 1-20.5-16. Abandonment.
It is the intent of the Authority that water or sewer
service to the customers of a utility not be interrupted by the
ebandonment or piacement into_receivership of the utility. To
that end:
~ (a) No person, lessee, trustee, or receiver owninq

r operating, managin , or controlling a utility shall abandon the

utility withaut givin 60 days notice to the municipalities in
which the utility is located, to the Authority, and to the Board
` (b) After receiving sueh notice, the municipalities or
Board acting ~ointly shall petition the circuit court of the
