A R~SOLUTION RESCINDING JURISDICTION

OF THE PUHI,IC SERVICE COMMISSION OVER ~
PRIVATE WATSR AND SSWER UTILITIES
WITHIN ST. LUCIE CUUNTY ;

WHEREAS, the Board of County Commissioners of St. Lucie
County, Florida, has made the following determinations:
1. On September 22, 1964, the Board of County Commissioners
adopted a resolution declaring that St. Lucie County is sub~ect
to the provisions of Chapter 367, Florida Sta~utes, thereby
establishing the ~urisdiction of the Florida Public Service
Commission over private water and sewer utilities within St.
Lucie County.
E 2. This Board has determined that the interests of the

~ citizens of St. Lucie County will be better served by regulating
private water and sewer utilities at the local level.
3. The St. Lucie County Water and Sewer Utilities
Regulatory Act, Chapter 86-347, Special Acts, Laws of Florida,
was adopted with the intent and purpose of authorizing the Board
~ to establish the St. Lucie County Water and Sewer Authority to
regulate private water and sewer utilities at the locai level.
4. On September 2, 1986, a referendum required by Section
25 of the St. Lucie County Water and Sewer Utilities Regulatory
i
Act was held at which time the qualified electors of St. Lucie
County voted to approve the St. Lucie County Water and Sewer
Utilities Regulatory Act by a margin of 10,954 votes to 4,526
votes. ~
