AFFIDAVIT
STATE OF FLORIDA
COUNTY OF ST. LUCIE
Before me the undersigned authority personally appeared
JOHN G. ALBRITTON, who af ter :,~ing du ly sworn, deposes and
says: ~
1. That I am JOHN G. ALBRITTON, and I am a Registered
Land Surveyor havinq Certificate Number 2791 and i was employec~
by Weatherington Land Surveyors on February 25, 1987~
• 2. That the leqal description at Official Records Book
492, Page 791, of the Public Records of St. Lucie County,
Florida which was a part of the Declaration of Condominium for
BREAKERS LANDING CONDOMINIUM, recorded in Official Records 8ook
492, Pages 760 through 872, was prepared by me as an employee
of Weatherington Land Surveyors based upon information
furnished by Robert Nelson and inadvertently contained an error
in the legal description by describing only the property lying
West of State Road A-1-A. The legal descrigtion in the
Declaration of Condominium should have also contained the
property lying East of State Road A-1-A.
3. That I have prepared-the Boundary Survey and have
reviewed the legal description, both of which are contained in
the Amendment to Declaration of Condominium being filed by the
Developer, Robert Nelson, and in the preparation of the
Boundary Survey and in my review of the legal description, the
error made originally in the legal description contained in the
` Declaration of Condominium is in fact corrected by the
~ Amendment.
~ 4. That it was the intent at the time of the original
~ incorrect legal description to make that description such as it
is contained in the new Amendment and that the error in
omitting the property lying East of State Road A-1-A was
inadvertent and unintentional.
~ 5. Further affiant sayeth naught.
