ORDERED and ADJUDGED as follows:
1. Defendant D. H. BRAGIN's Motion to Dismiss for failure to
state a cause of action against him is granted.
2. Plaintiff's Complaint is hereby amended by interlineation
to exclude all references to D. H. BRAGIN. .
3. The Answer and Affirmative Defenses of the defendant, WINN
DIXIE STORES, INC., are hereby deemed to be taken as WINN DIXIE's
responsive pleadings to the Complaint as amended by interlineation.
4. Each party shall bear its own costs associated with this
` stipulation and order, if any.
