ORDER
The Wife's Motion for Visitations came on for hearing on August 10,
1987, and the Court having heard testimony of the parties and having
been otherwise advised in the premises, it is
Florida-shall be deemed the home state with respect to the children ~
of this marriage.
2. The son Tony John (TJ) shail visit with the father until 5:00 p.m.
on August 30, 1987, at which time both children shall be deli~vered by the
Husband to the Wife to remain together with the Mife through 5:00 p.m.
Septen~ber 12, 1987, at which time Brian shall return to the Hus~and. The
Nusband sha,ll either pravide travel for the children personally or provide
~ -
for their air travel in accordance with this schedule.
3. Any failure to deliver the children to the parent entitled to have .
~ the children at the appointed time shall be deemed kidnapping pursuant to
Florida Statute 787.04 and the appropriate federal statute regarding such
matters, and any violations shall be sub3ect to strict imposition of
~ sanctions by this Court.
4. Each parent shall have open, unmonitored and unrestricted written
~ conmunications and telephone access to the chil~ residing with the other
parent.
5. Predicated upon the Nusband's representations to the Court tha:: he
will have moved to Martin County, Florida, permanently on or before November ~
1, 1981, the two children shall spend each weekend together commencing r~ith _
the first weekend in November with the Nife, thereafter alternating between ~
the Husband and Wife on a weekly basis.
