(g) In the event of the foreclosure of this Mortgage
or any other transfer of title to the Mortgaged Property in
extinguishment or partial extinguishment of the Secured
Indebtedness, all right, title and interest of Mortgagor in and
ta all insurance policies then in force shall pass to the
purchaser or to Mortgagee, as the case may be, and the Mortgagee
is hereby irrevocably appointed by Mortgagor as attorney-in-fact
for Mortgagor to.assign any such policy to said purchas~r or to
Mortgagee, as the case may be, without accaunting to Mortgagor
for any unearned premiums thereon.
1.08 Care of Mortqaqed PropertY. Mortgagor shall maintain
the Mortgaged Property in good condition and repair, shall not
commit or suffer any waste to the Mortgaged Proper~y, and shall
comply with, or cause to be complied with, all restrictive
covenants, statutes, ordinances and requirements of any
governmental authority relating to the Mortgaged Property and the
use thereof or any part thereof. Mortgagor shall promptly
repair, restore, replace or rebuild any part of the Mortgaged
Property, now or hereafter encumbered by this Mortgage, which may '
! be affected by any proceeding of the character referred to in
~ Section 1.09 herein. No part of the Mortgaged Property,
including, but not limited to, any building, structure, parking
lot, driveway, landscape scheme, timber or other ground
improvement, equipment or other property, now c~r hereafter
conveyed as security by or pursuant to this Mortgage, shall be
removed, demolished or materially altered without the prior
written consent of Mortgagee. Mortgagor shall complete, wi~hin a
. reasonable time, and pay for any building, structure or other
improvement at any time in the process of construction on the
property herein conveyed. Mortgagor shall not initiate, join in
or consent to any change in any private restrictive covenant,
zoning ordinance or other public or private restrictions limiting
or defining the uses which may be made of thP Mortgaged Property
or any part thereof without the prior written consent of
Mortgagee. Mortgagee and any persons authorized by Mortgagee
shall have the right to enter and inspect the Mortgaged Property
at all reasonable times and access thereto shall be permitted for
tha~ purpose.
1.09 Condemnation. Notwithstanding any taking of any
property, herein conveyed and agreed to be conveyed, by eminent
domain, alteration of the grade of any street or other injury to,
or decrease in value of, the Mortgaged Property by any public or
quasi-public authority or corporation, Mortgagor shall continue
to pay the Secured Indebtedness, and any reduction in the Secured
Indebtedness resulting from the application by Mortgagee of any
award ar payment for such taking, alterations, injury or decrease
in value of the Mortgaged Property, as hereinafter set forth,
shall be deemed to take effect oniy on the date of Mortgagee's
receipt of such award or payment. Condemnation proceeds shall be
applied as follows:
