deemed to be received on the date of personal delivery thereof,
or if mailed, on the date of delivery indicated on the return
receipt (or if delivery thereof is refused by the party to which
such notice is addressed, on the date of such refusal).
(b) Any party may change the address to which any such
notice, report, demand or other instrument is to be delivered or
mailed, by furnishing written notice of such chang~ to the other
parties, but no such notice of change shall be effective unless
and until received by such other party.
3.03 Headinqs. The headings of the articles, sections,
paragraphs and subdivisions of this Mortgage are for convenience
of reference only, are not to be considered a part hereof, and
shall not limit or expand or otherwise affect any of the terms
hereof.
3.04 Invalid Provisions to Affect No Others. In thg event
any of the covenants, agreements, terms or provisions contained
in this Mortgage shall be invalid, illegal or unenforceable in
any respect, the validity of the remaining covenants, agreements,
terms or provisions contained herein shall be in no way affected,
E prejudiced or disturbed thereby.
3.05 Chanqes, etc. Neither this Mortgage nor any term
hereof may be changed, waived, discharged or terminated orally,
or by any action or inaction, but only by an instrument in
writing signed by the party against which enforcement of the
change, waiver, discharge or termination is sought. Any ~
agreement hereafter made by Mortgagor and Mortgagee relating to
this Mortgage shall be superior to the rights of the holder of
any intervening lien or encumbrance.
3.06 Governinq Law. This instrument shall be governed by
and construed and enforced in accordance with the laws of the
State of Florida.
3.07 Remedies. Mortgagee shall have the right from time to
time to sue for any sums, whether interest, premiuan, principal or
any installment of any or all thereof, taxes, penalties, or any
other sums r~quired to be paid under the terms of this Mortgage,
as the same become due, without regard to whether or not all of
the Secured indebtedness shall be due on demand, and without
prejudice to the right of Mortgagee thereafter to enforce any
appropriate remedy against Mortgagor, including an action of
fareclosure, or any oth~er action, for a default or defaults by
Mortgagor existing at the time such earlier action was commenced.
3.Oa Riqhts of Mortqaqee. The rights of Mortgagee granted
and arising under the clauses and ~ovenants contained in this
Mortgage shall be separate, distinct and cumulative of other
