WITNFSSE?Hs That WHEREAS, 'THERESA E. LYDECKER died testate a ~esident ~
of Suffolk County, Massachusetts, on January 15, 1985, seized and possessed o# the rea! ~
prope: ty herelnafter described; and
WHEREAS, title to said property passed to the party of ttie second part pursuant
to an assignment by the Estate of RITA MARY WENTZELL and pursuant to the
provisions of the dec~dejit's Will and Testament, which was admltted to probat~ and
cecorded by the Circuit Court for St. Lucie County, Flortda, Probate Division, in Case `
No. 87-78 CP subject only to the right of the party of the first part to sell or
encumber the property for the purpose of defraying ctaims, cost, and expenses of
administraiton of decedeni's estate; and ~
'AIHEREAS, the party of the first part wishes to distribut~ said property to th~
party of the second part and evidence the release of the property from said rlght to ~ ,
seli or encumbec,
NOW THEREFORE, in connection with the foregoing.and in connection with the
dIsiribution of the estate of said ~e~cedent, the party of the first part has released to ~
the party of the second part the rlght to sell or encumber sald p~roperty and hereby ~
grants, conveys and confirms ~ unto tf~e party of the second part, his heirs and assigns
forever, all of the interest of said decedent in and to real property situated in Sarasota ~
County, Florida, described as foltows: .
Lot 17, Block 1392, of 28 ADDITION TO PORT
CHARLOTTE SUBDIVISION, a Subdivision according to ;
the Plat thereof, as recorded in Plat Book I5, Page 12, of ~
the Public Records of Sarasota l:ounty, Florida ~ i
T4 HAVE AND TO HOLD, the same in fee simple forever.
. TOGEYHER with a!t and singular the _ tenements, hereditaments, and
appurtenances betonging to or in any way appertaining to that real property, subject to
all restrictions, reservations, and easements of record, if any, and ad vatorem tauces
for the current year.
Because this deed is given in distribution of assets of a decedent's estate, and
, involves the assumption of no, mortgage, minimum state documentary stamps are
affixed. '
