8. James Fyfe died on January 14, I987, and his last will
and testament dated ~une 20, 1985, copy attached as Exhibit "A",
leaves his estate to his wife, Helen Gaynell Fyfe, if living, and
if not to William Hoffman, James Hoffman, Janice Reller,
Barbara Blacklock, Mary Jo Rogers, Mary Alice McCormick, William
K. C•,~ryer, David Jones, Thomas L. Jones, and Michael B. Jones, in
equal shares, share and share alike, per capita.
R. All of the beneficiaries listed in the Last WiII and
Testament of J~mes Fyfe are nieces and nephews of the decedent
and his former wife, Helen Gaynell Fyfe, James Fyfe and Helen
Gaynell Fyfe having no children or lif=~a1 descendants. -
10. James Fyfe married PaulinE Fyfe in the latter part
of 1986 after the demise of Helen Gaynell Fyfe.
I1. Pauline R. Fyfe survived the decedent and is his
pretermitted spouse.
12. Based upon informat~on and belief, no provision has
been made for~ or waived by, the decedent's spouse, Pauline R.
Fyfe, by prenuptial or postnuptial agreement.
13. Pauline R. Fyfe is not provided for in the last will of `
the decedent, and the decedent's will does not disclose an
intention not to make provision for Pauline R. Fyfe.
,Petitioner requests that this court enter an order

~etermining the beneficiaries of this Estate, indicating the ~
~hare or amount each is entitled to receive.
Under penalties of perjury I declare that I have read the
foregoing and the facts alleged are true, to the best of my
kno~ledge and belisf. ~
