ALBERTSON by Paul H.Freeman, as Trustee, together with all
interest accuring thereon subseguent to the date hereof, a true
copy of which is attached hereto as Exhibit A. ;
B. A21 of ALBERTSON'S right, title and interest in and ~
to those certain security interests given by Paul H. Freeman, as
Trustee, to secure payment of the Promissory Note being herein
assigned, said interests being described as: Second Purchase Money
Mortgage dated September 3, 1982 given by Paul H. Freeman, as
trustee, as Mortgagor, a true copy of which is attached hereto as
Exhibit B; Security Agreement dated September 3, 1982, qiven by
Paul H. Freeman, as Trustee, Debtor, a true copy of which is
~ ~ attached hereto as Exhibit C; and Escrow Agreement dated September
3, 1982, a true copy of which is attached hereto as Exhibit D.
2. This assignment is expressly conditioned upon the j

agreement of BOWEN to assume and pay according to its te'rms that I
certain first mortgage held by The Equitable Life Assurance ~
Society of the U.S. dated January 9, 1978, and being recorded in
I,
O/R Book 280, page 1403, public records of St. Lucie County,
Florida, which mortgage has a present principal balance of
$240,0p0.00 and which encumbers the same premises located in St.
Lucie County, Florida, which serve'S as the security for the
Second Purchase Money Mortgage being herein assigned by ALBERTSON
to BOWEN.
3. This Assignment shall be considered as an absolute
transfer f all of ALBERTSON'S right, title and interest in and to
. the various interests being assigned and not as an assignment for
security purposes only.
4. ALBERTSON hereby warrants that he is the lawful owner of
the various interests being assigned hereunder and that same are
free and clear of all liens, defects or encumbrances of whatsoever
nature ar kind.
