MORTGAGE
~
THIS MOR'PGAGE DEED executed this ~~~'ay of MARCH ~
A.U., 1988, by JAMES E FARRELL, JR ~ A MARRIED MAN ~
party of the first part (hereinafter called "Mortgagor"), to
WESTON-FLORIUA DEV~LOPMENT CORPORATION - FT. PIERCE #I, a Florida 0~/
corporation, party of the second part (hereinafter referred to as
"Mortgagee"), I~
W I T N E S S E T H:
That for divers good and valuable considerations, and also in
consideration of the aggregate sum named in the Promissory Note or
Notes, hereinafter described, the Mortgagor does grant, bargain,
sell, alien, remise, release, convey and confirm unto the
Mortgagee, in fee simple, all of that certain tract o~ land of
which the Mortgagor is now seized and possessed and in actual
possession, situate in St. Lucie County, Florida, described as
follows, to wit:
Condominium Unit _910, SEA POINTE TUWERS OF FORT PIEKCE, •
a Condominium according to the Declaration of ~
Condominium, thereof recorded in Official Record Book ~
435, Page 1463 et seq., and Corrective Declaration of ?i
Condorninium recorded on April 1, 1987, in Official
Record Book 536, page 2768, BOTH being of the Public
Records of St. Lucie County, Florida, together with all
of the appurtenances thereto, as set forth in said
Declaration of Condominium.
Together with all and singular the tenements, hereditaments
and appurtenances thereunto belonging or in anywise appertaining, ~
I and toyether with all agricultural, horticultural and fruit crops,
now planted and/or growing, and hereafter ~lanted, grown or
raised, on the above-described land, and also any time hereafter
erected thereon, together with and including all of the boilers, 4
rnacnines, heating plant, lighting plant, and all plumbing ~
equipment, toilets, basins, electric heating and lighting plants,
lighting fixtures, power machinery, plant or plants for running 1
and operation of passenger or other elevators, including passenger
and other elevators, now or hereafter located in the buil_ding upon
said land, and all other machinery, appliances and apparatus now
ar hereafte~ placed on said premises, either in renewal or
replacement of fixtures, machinery, appliances and appurtenances
originally installed on said premises, in connection with the
c:ompletion thereof or in addition thereto, ~~hich may hereafter be
placed upon the above-described land, and which said
fixtures, machinery, appliances and appurtenance the Mortgagor
warrants shall be free froin any encumbrances, retention of title
or other claims in favor of any other person and that this Deed
shall be a first lien thereon, -
TO HAVE AND TO HOLD all and singular the said property hereby
conveyed, mortgaged, pledged or assigned by the Mortgagor, or
intended so t~ be, unto the Mortgagee, in fee simple.
And the Mortgagor covenants with the Mortgagee that the
Mortgagor has full power and lawful right to convey said mortgaged
~~roperty as aforesaid; that it shall be lawful for the Mortgagee
at all times peaceably and quietly to enter upon, hold, occupy and
enjoy said mortgaged property; that the same is free from all
encurnbrances exce~t as herein specifically set forth; that
the Mortgagor will make such further assurances to perfect the
title to said mortgage property in the Mortgagee as may reasonably
be required; that the riortgagor hereby fully warrants the title to
