I THIS REI~EASE, given by ST. LUCIE COUNTY, a political sub-
; division of ~he State of Florida, to DONpLD H. DeMBtILES,
. W I T N E S S.E T H :
WHEREAS, on ~or about January 18, 1978, the Board af
Adjustment f~~ St. Lucie Cour~ty, Florida granted Donald H.
~I DeMeules a variance trom the pzovisions of the Comprehensive ~
Zoning Resolution for said county to construct a home upon the
. ~ollowing described land: ~
West 264 feet of the East 792 feet of th~ North 165 feet
. ~ of ~he Sou~heast 1/4 of th~ Southeast 1/4 of Section 5,
• Township 36 South, Range 40 East; -

WHEREAS, at the time of granting the ~aid variance, the
above-de~cribed land did not have frontage on a dedicated
road; and

WHEREAS, said variance contaihed a provision to the ~
e~fec~c tha~ in t
he event said land was sold to a third party
-the said Dortald H. DeMeules would prov~de such third party
wi~h a german~nt 50 foot easement for ~ingress and egress from
Hawley Road to said land;.and
. WHEREAS, in order to induce the St. Lucxe.County Building
Zoning Department to issue a pexmit to build ~ home on the
aforementioned land, the said Donald H. DeMeules on March 7, ~
~ 1978 executed an Affidavit acknowledging his obligation to -
provide a permanent 50 foc~t easement for ingress and egress ~
. ~ from Hawley Road to ~aid lar.d upon any sale _ to a third party,
- which. Affidavit is re~orded in Official Recard Book 283 at
Page 1793 of the Public Records of St. Lucie County, Florida;
and -
WHER~AS, the sai.d Don31d H~. ~eMeules has included the
above-described land in a plat in Lucy Acres S~bdivision~re-
corded in P1at Baok 23.at Page 12 of ~he Public Records of
St. Lucie Cbunty, Flarida; and ~
~ WHEREAS, the said plat of Lucy Acres Subdivision includes
a 6(' foot roadway that has been dedicated to.public use, which
roadway provides ingress and egress from Hawley Ro~d to the -
- above-described land. . - -
NOW, THEREFORE, in consideration of th~ premises ST. ~
LUCIE COUNTY, FLORIDA, does hereby release DO'rIALD H. DeMEULES
from all obZigations, ~xpressed or implied, as provideci.in
~that certain Atfidavit dated March 7, 19?$ ~nd recorded in
Official Re~ord Book 283 at Page 1799 of the Public Recor~3s of
~t. Lucie ~oun~y, Florida. - -
