FINAL JUDGMENT
THIS CAUSE came on Por trial before th~ Court without a,~ury, with
R.ALPH L. FLOWERS, FSQUIRE, appearing as Attorney for Plaintiff, MARVA
WA`rSON end JOSEPH DeROSS, ESQUIRE, appearing as Attorney for Defendant,
NORMAN McDOUGAI.?D. The i.~:~rt having heard ~the testimony and examining the ~
proofs offered by the respecti~~e parties, and the Court being fully advised
in the premiseg, makes the following fin~iings of fact;
1.~ That title to a green 1981 Ford pickup truck, bearing Vehicle ~
Identificatio~ number CTF1006BNA18089 is titled in name of Plain~iff and
' a green 1979 Ford LTD automobile, bearing Vehicle Identification number
9A64F113529, is titled in ~oint names of Plaintiff and Defendant.
2. That Plaintiff paid-fro?u her separate personal funds, the amo~.nt
of $1,500.00 as a down payment on the Ford LTD sutomobile and subsequently,
made all payments from her separate and personal furids to complete the
p~yment f~r said automobile.
3. That since the purchase of the 1981 Ford truck, Plaintiff has .
paid ~~,'i~3.50 toiaard tYie payment of said truck from her personal funds.
4. That in September, 1981, Defendar,t, NORMAN McDOUGALD, ~bsconcled
with said automobile and truck, and the same are now in his possession ~
in Indian River County, Florida. ~
5. That on or about Septennber 25, 1981 , Def~ndant, witr.out eon-
sent of Plaint~ff, illegally caused the title and rigistratian on the -
- Ford truck to-be place~ and recorded in h~~ so~.e name. That fur~cher, the
~ Court Finds that this actian by Defendant is void and of no legr~l effect
and that Plainti~f is entitled to ax~ equitable l~ien thereon.
6. That because of DPfendarit absconding with said vehiclES, Plaintiff ~
- was required to lease an automabile for transpc~rtation and suffered a loss
of income,~all totalling ~2,178.1~. ,
