(ii) The amount of Three Mi11Ion Eight Nundred Thousand
Dollars (33,800,000.00) set forth in psragraph I6 entitled "Future
Advanees" is fiereby amended to rePd Fifteen Miluon Uollars
(s15,000,006.00). .
Accordingly, the terms, covenants and conditions set forth in the Seaseape I
Mortgage, Catamaran II Mortgage, Seaseape A Mort~age and First Capital ~
MortRsge are hereby superseded and replaced by the terms of the Consolldated -
Mortgage. ,
E. That the terms and con~litions set forth in that certain
Agreement to Release dated December 22, 1~81, are hereby incorporated into this
. Agreement as fully and completely as if seme had been set forth herein in their
entirety. Aeeordingly, the Mortgage~ shall execute a~d deliver to Mortgagor a
partial release releasing each Seascape I Unit, Catamaran II Unit, and 3~aseape II
Unit {as such terrrms are defined in said Agreement to Release) from the lien of the
Consolidated Mortgage upon the terms and conditions set forth in said Agreement
~ to Release.
- F. The aggregete principal balance evidenced by the
aforedescribed notes of Nine 1Vlillion Ei~ht H~~ndred Thlrty Two Thousand Four
Hundred Seventy Seven Dollars and 85l10a (~~,832,477.85), plus interest, shall be
paid in aceordance with the terms and conditions of said notes, as now or hereafter
~ amended individually or colleetively. The final peyment date under the Seascape I
Notes, Seascape II Notes and Seeond Capital Note have been simultaneously
herewith extended to November 1, 1982. Accordingly, the final payment date
under each of the aforedescribed notes, as of the date hereof, is as follo.ws: _
Seascape I Notes - November 1, 1982; Catamaran II Note -May 31, 1983; Seascape
II Idotes -November ~1, 1982; First Capital Note - 1Viay 31, 1983; and Second Capital
Note -November 1, 1982.
G. It is represented by the Mortgagor to the l~iortgagee that
there is neith~r documentary stamp tax nor intangible personal property tax due
the State of Florida with respeet to any of the trensactions referenced herein not
~ heretofore ar concurrently h~rewith being paid by Mortgegor. But in the event the
State of Florida does require payment for additional documentary stamp texes or
intangible personal property taxes in conneetion therewith, the Mortgasor shall Qay . -
