§9601, et seq,~ the Toxic Substances Control Act~ 15 U.S.C.
§2601~ et seq~, the Resource Conservation and Recovery Act,
42 U.S.C, §6901, et seq~~ the Water Quality Act of 1987, 33
U.S.C. §1251, et seq~, and th~ Clean Air Act, 42 U.S.C.
§7401~ c~t seq.~ and any sta(e or local statute ordinance~
law, code, rtile, regulation or order regulating or imposing
liabilicy (iricluding strict liability) or standards of
conduct regarding tia~ardous Substances (heceinafter the
"F.nvironmental Lavs"), but does not include such substances
as are permanently incorporated into a structure or any
part thereof in such a r+ay as to preclude their subsequent
release into the environment, or the permanent or temporary
storage or disposal of household hazardous substances by
tenants~ and which are thereby exempt from or do not give
rise to any violation of the forementioned Environmental
Lavs.
3. The legal descrip[ion of the real es[ate attached as F.xhibit A
to the Mortgage is hereby deleted in its entirety and the legal description of
ctic~ rt:a: estate set for?_h in Exhibit A attached to this Modification is hereby
~t~bsti[uted therefor.
4. Except as modified herein the Mortgage shall remain in full
!or~e and effect in all respects as originally r+ricten and nothing hereiri
sh~ll affect or impair any rights and poWers r+hich Lender has thereunder.
~ 5. Borror+er covenan[s that it vill perform and ebserve all of the
; covenants, agreements, stipulations and conditions on its part to be performed
~-~t~rsuant to the terms of the Mortgage.
