HomeMy WebLinkAbout0272 1020400 PARTIAL RELEASE OF MORTGAGES AND RELATED DOCUMENTS WNEREAS, HARBOR FEDERAL SAVINGS AND LOAN ASSOCIATION (hereinafter referred to as "Mortgaqee"), is the owner and holder of certain Mortqages and Security Agreements (hereinafter referred to as "Mortgages"), dated April 22, 1983, recorded in Official Records Book 399, Page 1330, Public Records of St. Lucie County, Florida; dated April 20, 1984, recorded in Official Records Books 429, Page 2845, Public Records of St. Lucie County, Florida; and dated May 7, 1985, recorded in Official Records Book 463, Page 2653, Public Records of St. Lucie County, Florida; and WHEREAS, the above referenced Martgages were executed by Harbour Ridge, Ltd., a Florida Limited Partnership, as Mortqagor, (hereinafter referred to as "Mortgagor"); and WHEREAS, Mortgagor has requested Mortgagee to release the premises hereinafter described, being a part of the mortgaged premises, f~om the lien and operation of the Mortgages. NOW, THEREFORE~ Mortgagee, in consideration of the premises and the sum of Ten Dollars ($10.00) paid by Mortgagor at the time of execution hereof, the receipt whereof is hereby acknowledged, does remise, release, quitclaim, exonerate and discharge from the lien and operation of the Mortgages, the land and improvements to the extent that it is part of the property encumbered by the Mortgages described as: UNIT 2-8, (the "Unit"j of POND APPLE VILLAGE, A CONDOMINIUM, (the "Condominium") according to the DECLARATION OF CONDOMINIUM thereof dated October 21, 1988, and recorded on October 24, 1988, in Official Records Book 608, Page 1050, Public Records of St. Lucie County, Florida, (the "Declaration of Condominium"), as amended, together with the undivided share ~ of the COMMON ELEMENTS of the Condominium declared in the Declaration of Condominium to be appurtenant thereto; together ~ with all appurtenances thereto, including, without limitation, ~ the right of exclusive use of those areas, spaces or portions ! of CONIIriON ELEMENTS of the Condominiu.m, declared in the ` Declaration of Condominium to be LIMITED COMMON ELEMENTS of the ~ Unit (the "Property"). ~ ' TO HAVE AND TO HOLD the same, with the appurtenances, to the € Mortgagor freed, exonerated and discharged of and from the lien of E the Mortgages, and every part thereof to the extent that it is a ~ part of the property encumbered by the Mortgages, provided, that ~ nothing herein contained shall in anywise impair, alter or diminish € the effect, lien or encumbrance of the Mortgages on the remaining ~ part of the property encumbered by such Mortgages, not hereby ~ released therefrom, or any of the rights and remedies of the holder ~ hereof . ~ This instrument shall also operate as a partial release of Mortgagee's security interest in the property described in those ~ certain Financing Statements recorded in Official Records Book 399, ~ Page 1338, and Amendment thereto recorded in Official Records Book " 595, Page 1817, Official Records Book 429, Page 2861, and Amendment thereto recarded in Official Records Book 599, Page 1822, and Official Records Book 463, Page 2668, and Amendments thereto recorded in Official Records Book 566, Page 1827, and Official Records Book 595, Page 1811, all Public Records of St. Lucie County, Florida, to the extent that the property described in the Financing Statements is part of the property hereby released.
