prevent ~either party from instituting an action for dissolution
of marriage in any competent jurisdiction based upon any past
or future conduct or circumstance nor to bar the other from
responding in any such suit. This Agreement may be offered in
evidence by either party in any such dissolution action and, if ~

acceptable to the Court, shall be incorporated by reference in
the judgment, if any, which may be rendered. However,
notwithstanding incorporation in the said judgment and if not R
contrary to existing law, this Agreement shall not be merged in i
but shall survive the judgment and be binding on the parties
~
for all times.
Each of the parties shall, from time to time, at the
request of the other and as may be required by this Agreement,
execute, acknowledge and deliver to the other party any and all
further instruments that may be reasonably required to give
i
~ full force and effect to the provisions of this Agreement.
Reconciliation shall not affect the provisions of this 4
I'' Agreement. ~

~ If on any applicable income tax return date hereafter, ~
~ ~
' the parties are still united in marriage, the Wife shall join
! the Husband in the execution of a joint Federal Income Tax
~
~ Return provided the said joinder is advantageous to either one
~ or both of the parties. The tax due on that return shall be
~
paid by the Husband and Wife in such percentage as their
€ individual income bears to the total income of the two parties.
~ In the preparation of this Agreement, the Wife had the
~
! opportunity to retain and was advised by counsel of her own
i
~ choosing and the Husband was represented by W. Jay Hunston,
~ Jr., Esquire, of North Palm Beach, Florida. The provisions of
~ this Agreement and their effects have been fully explained to
~
~ the parties by their respective counsel and each party
acknowledges that the Agreement is fair and equitable, that it
is being entered into voluntarily, and that it is not the
result of any duress or undue influence.
; This Agreement shall be construed by and governed in

~ accordance with the laws of the State of Florida.
