PROMISSORY NOTE ~
$9.000.00 0, 1990
FOR VALUE RECEIVED the undersigned promises to pay to
the order of EMMA T. ASHLEY, as Personal Representative of the
Estate of JOSEFHINE K. TAYLOR, deceased the principal sum of NINE
THOUSAND AND no/100 (59~,000.00) Dollars, together with interest
thereon from DATE at the rate of TEN (10$) percent per annum,
until maturity. The said principal ar?d interest beinq payable at
P.O. Box 987, Stuart, Florida 34995, or at such other place as
the holder hereof may designate in writing. The said principal
and interest shall be payable as follows; `
In equal monthly installments of $225.00, the =
first such installment being due and payable ~
on the ~ S7 day of February, 1990 and each
succeeding installment being due and payable~
on the same day of each and every month
thereafter until•all principal and interesC
are fully paid.
This note may be prepaid after date without penalty.
This note is secured by the mortqage of even date
herewith and is to be construed and enforced according to the
1 aws of the State of Fl or ida . Upon the f a il ure of the make r
hereof to pay any sum required to be paid by the terms of this
note,~or the securinq mortgage, stipulation, agreement or ±
covenant of this note or of the securing mortgage, for a period
of more than Thirty (30) days, the entire sum of principal and
intereet remaining shall, at the option of the holder hereof~
become immediately due and payable. Failure to exercise said
option shall not constitute a waiver of this right to the same at
i any subsequent time. °

~ ~ If this note or mortgage becomes in default because of

~ any failure to abide by provisions of either, all sums due under
' this note shall bear interest at the rate of THIRTEEN (138)

~ The maker and endorser agrees to pay all costs of =
collection, together with a reasonable attorney's fee, including '
r a reasonable attorney's fee in an appellate proceeding, in the
E event this note, including any installment payment, is not paid
~ promptly when due, and the same is given to an attorney for ;
collection, whether suit be brought or not. ~
