The property is encumbered by a first mortgage with FIRST 1

principal balance of FIFTY NINE THOUSAND DOLLARS AND NO/100'S ; i

($59,OOO.QO) and a second mortgage with JOANNA MAUS, having an ;
approximate principal balance of NINETEEN THOUSAND DOLLARS AND ;
NO/100'S ($19,000.00). The Husband shall have exclusive use and
,possession of the marital residence for as long as the Husband's
Mother, MELBA C. ROWANL~, is alive. The parties further agree
that upon the death of MELBA C. ROWAND, that the property shall ~
be put on the market for sale as expeditiously as possible. The
property shall initially be listed at a current market value as

agreed upon by both the Husband and the Wife ~ The Husband shall
' occupy the premises during the sale period and shall pay all

i mortgage payments, taxes, insurance and maintenance expenses

f during the sale period. The parties shall equally divide the net
~ proceeds of the sale, net proceeds divided being defined as those

g SIXTH_ The Wife is the owner of a 1988 Mitsubishi

g Stationwagon titled in her sole name. The Wife shall assume, be ;

~ liable for, and save the Husband harmless from any and all
indebtedness owed on said vehicle. Said 1988 Mitsubishi
Stationwagon shall remain the property of the Wife, and the
r Husband agrees to assert no claim, or right, title and interest
