23. NOTICE. Except for any notice required under applicadle law to be give~ in another manner, (a) any notice to Borrower pruvided for in this
Mortgage shall be given by mailing such notia by certified mail addrased to Borrower at the Property Address ot at such otAer addras at Borrow er may
dcsignate by notice to Lender u providcd herein, and (b) any ootice to Lender shall be given by cenified mail, return receipt reyuatcd, to Lender's
addras stated hcrein or to such other addras as Lender may daignate by notice to Borrower u providcd herein. Any nutice pro~ ided for in this
Mortgage shal! be dcemed to hzve been given to Borrower ot Lender when given in the manner daignated hcrein.
24. ACTIONS AGAINST LENDER. If any aaion or proaeding shall be commenced by any penon other than the Lender (except an action to
forcclose this Mortgage, or to oollect the debt serured tAereby) to which action or procecding the Lcnder is made a party, or in which it shall become
necessary to defend or uphold the lien of this Murtgagt, all surtu incvrrtd by the Lender for the expcnse of any such litigation ~including but not limited lo
rcasonable attorneys'and paralegal (ea, costs, and expensa through the trial and appeliate levcls) shall be paid by the Borrower, together with interat
thereon at the rate payable f~om time to time on outstanding principal under the Note unlas payment of interat st such rate would be contrary to
applicable law, in which event such amuunts shall bear interat at the highest rate permissible under applicable law, upon demand by tht Lender.
25. RELEASE. lipon paymcnt of all sums secvred by this Mongage, Lender shall release this Mortgage without charge to Borrower. Borrower shall
pay all costs of remrdation, if any.
26. ATTORNEYS' FEES. As usec! in this Mortgago and in the Note, attorncys'tees'shall include attorneys' fees, if any, which may be incurred on
appeal and in any bankruptcy or administrative proceedingc.

As used herein, the term lcnder'shall include, without limitation, FIRST NATIONAL BANK AND TRUST COMPANY OF TNE TREASURE

In construing this Mortgage, the singular shall indude the plural, the plural shall include the singulu, and one gender sha11 include all genders.
