FIFTH: Each party shall, upon request of the other,

execute, acknowledge and deliver any and all deeds or other
`'i instruments of release or conveyance, as may be necessary to

enable the other party to effectuate the intent, purposes and
provisions of this Stipulation and Property Settlement Agreement.~

` SIXTH: The parties agree that the business that they

formerly owned known as "Chobee Road Liquors" is defunct and thatf
the Former Husband acknowledges that there were no profits andior ~
~ monies made upon the closing of the business by the Former Wife. ~
Therefore the Former Husband agrees that the Former Wife owes to ~
~ him no sum of money whatsoever from the closinq of "Chobee Road
~ ' f
Liquors". ~

, SSVENTH: Modification ar waiver of any of the provisions of ~

~ this Stipulation and Agreement shall be effective only if made

~ in writing and executed with the same formality of this

~ Stipulation and AQreement. Failure of either party to insist ~

~ ` upon strict performance of any of Lhe provisions of this y

any subsequent default of the same or similar nature. ~
