THIS WA,RRANTY DEED made the 13th day of January, 1990 by
DONALD R. GIANNELLI and FR~NCBS GIANNELLI, husband and wife,
hereinafter called the Grantor, to ARNOLD KAPLAN and JF,.P?N D. KAPL~N,
husband and wife, as tenants by the entireties. whose post office
address is 446 Cart Court, Poinciana, Florida 34759, hereinafter
called the Grantee: (Wherever used herein the term "grantor" and
"grantee" include all the parties to this instrument and the heirs.
legal representatives and assigns of individuals, and the successors
and assigns of corporations).
WITNESSETH: That the grantor, for and in consideration of the sum
of Ten Dollars ($10.00) and other valuable considerations, receipt
whereof is hereby acknowledged, hereby grants, bargains, sells,
aliens, remises, releases, conveys and confirms unto the grantee,
all that certain land situated in St. Lucie County, Florida, viz:
Lot 33, Block 10, of ST. LUCIE WEST COUNTRY CLUB ESTATES, Parcel 8--
Phase I, as shown on Plat Number 2 of St. Lucie West, recorded in
Plat Book 26, pages 9, 9A through 9G, in the public records of St.
Lucie County, Florida.
SUBJECT TO all of its exhibits, easements, restrictions,
reservations, rights-of-way, limitations of record, zoning and
other prohibitions imposed by qovernmental authority and real
property taxes subsequent to December 31, 1988, and those contained
in Warranty Deed recorded in Official Records Book 604, page 1151,
public records of St. Lucie County, Florida.
` TOGETHER with alI tenements, hereditaments and appurtenances

~ - TO HAVE AND TO HOLD, the same in fee simple forever.

~ AND the grantor hereby covenants with said grantee that the
grantor is lawfully seized of said land in fee simple; that the

~ said land and will defend the same against the lawful claims of all
; persons whomsoever; and that said land is free of all encumbrances,
~ except t3xes accruing subsequent to December 31, 1989.
