STEWART, and dated the day l of -C~~~M~F/e . 198~. I i WITNESSETH: WHEREAS, on January 10, 1984, the parties entered into a Property Settlement Agreement which, among other things, provided for primary physical residency of the minor child of the parties, to-wit; SHARRON STEWART. Said Property Settlement Aqreement being incorporated in the Final Judgment of Dissolution of Marriage, dated January 11, 1984, in Case No. ' I` 83-209 FR-01; and I i WHEREAS, the parties have discussed the primary ~ physical residency of the child in the event that the mother, LYDIA MACHADO STEWART, were to become incapacitated, incompetent ~ or deceased prior to the child's reaching eiqhteen (18) years of age; and WHEREAS, both of the parties acknowledge that the mother's natural father, GUS MACHADO, (with whom the child is currently residing) would be the best individual to have primary ( physical residency of the child. ' ~i NOW, THEREFORE, in consideration of the mutual ' ~ covenants and conditions hereinafter contained, the Farties f ~ f ~ agree as follows. € ~ ' 1. That in the event of the death, incapacity or ~ ~ . ~ incompetence of the mother, LYDIA MACHADO STEWART, during the i +I minority of the child, the father, GARNA W. STEWART, irrevocably ~ ~ consents that p~rimary physical residency of the child shall vest ¢ with GUS MACHADO. : ~ 2. The father shall retain shared parental ~ responsibility in raising and rearing of the minor child and ~ shall retain reasonable riqhts of visitation. ~ 3.
