As, if and when Phase II is added, the commonl elements shall include the property described on the recorded supplement or amendment to the same extent as described in Sections 7~$Y~~Y ~~t~ 7~$~(~Y 7[A)[2)(a) and 7(A)(2)(b) above. ( Q/ ~ If the Developer does not canstruct the Unitsl on the proposed Phase II property as contemplated in Article 4 hereof, the Developer reserves the right nevertheless to add some or all of the proposed Phase II property and any ~ improvements thereon to the common elements of the ~ Condominium by recording an amendment to this Declaration in ~ accordance with the provisions of Section 9(D) hereof. ~ 4 The following easements are hereby granted froml ~ each Owner to each other Owner in the Condominium and to the j Association: j ~ Easements through the common elements f orl ingress and egress, use and enjoyment. ~ An easement of support in every portion of I a IInit which contributes to the support of any building of the Condominium. 3! S~ An easement for the purpose ofl installation, maintenance, operation, repair and replacement of all sewer, water, power and telephone lines, mains, conduits, wire, and any and all other equipment or machinery necessary or incidental to the proper functioning of any public or private utility or telephone system and cable television. ~j/ ~ An easement through any Unit committed tol the Time Sharing Plan and common elements therein, f or maintenance, operation, repair and replacement of such Unit and common elements. Access to Units shall only be during reasonable hours, except that access may be had at any time in case of emergency. ~ Except with respect to the limited common) ~ elements described in Section 7~$y 7(A)(2)(a) hereof, alll Owners shall have the right to use the common elements, subject to the terms and conditions set forth herein.
