PARTIAL RELEASE OF MORTGAGE
Know All Men by These Presents:
WHEREAS, THOS. J. WHITE DEVELOPMENT CORPORATION, a Florida
corporation, ("Mortgagor') is party to that certain Mortgage, dated
May 29~ 1986, and recorded November 26, 1986, in O.R. Book 0522, page
0665; Mortgage Spreader Agreement, filed October 8, 1987, i~ O.R. Book
0560, page 1198; Agreement for Subordination of Mortgage, filed in O.R.
Book 547, page 2021; and ~lortgage Spreader Agreement filed December 10,
1987, in O.R. Book 0567, page 0868; all of the public records of St.
Lucie County, Florida ("Mortgage"), in favor of MERCANTILE BANR
NATIONAL ASSOCIATION, a national banking association ("Mortgagee"), the
premises therein particularly described to secure the aggregate sum of
Six Million Dollars and no/100 ($6,000,000.00), with interest as
therein mentioned.
AND WHEREAS, Mortgagor has requested the Mortgagee to release the
premises hereinafter described, being part of said mortgaged pfemises, ~
from the lien and operation of the Mortgage;
NOW THEREFORE, RNOW YE, that the Mortgagee in consideration of the
premises herein and the sum of Ten Dollars ($10.Q0), to it paid by the ~
Mortgagor, at the time of the execution hereof, the receipt whereof is
hereby acknowledged, does remise, release, quit-claim, exonerate and
discharge from the lien and opera~ion of the Mortgage unto the
Mortgagor, its heirs and assigns, all that piece, parcel or tract of
land being part of the premises conveyed by the Mortgage, to-wit:
Lot 23-; Block 3 of ST. LUCIE WEST COUNTRY CLUB ESTATES,
Parcel 8--Phase I, as shown on Plat Number 2 of St, Lucie
West, recorded in Plat Book 26, Pages 9, 9A throagh 9G in '
the Public Records of St. Lncie County, Florida.
TO HAVE AND TO HOLD the same, with the appurtenances, unto the
said Mortgagor, its heirs and assigns forever, freed, exonerated and
discharged of and from the lien of the Mortgage, and every part
thereof; provided always, nevertheless, that nothing herein ~ontained
shall in anywise impair, alter or diminish the effect, lien or
encumbrance of the Mortgage on the remaining part of said mortgaged
premises not hereby released therefrom, or any of the rights and
remedies of the holder thereof.
IN WITNESS WHEREOF, the Mortgagee has caused these presents to be
executed in its name, and its corporate seal to be hereuntor~ffixed, by
its ro er officer thereunto duly authorized, the day of
