WARRANTY DEED
THIS WARRANTY DEED made the 24th of January, 1990, by TtiOS. J. ~
WHITE DEVELOPMFN'P CORPOR~TION, a Florida corporation (hereinafter
called the "Grantor"), and CLIIdT WESTHERItY, INC., a Florida ~
corporation. whose address is 590 Nw Peacock Loop, Ste. 7, Port St.
Lucie, F1 34986, (hereinfter called the "Grantee") (whenever used
herein, the terms "Grantor" and "Grantee" include all the parties to
this instrument and the heirs, legal representatives and assigns of
individuals, and the successors and assigns of. corporations); ~
W I T N E S S E T H: '
Grantor, for and in consideration of the sum of Ten ($10.00)
Dollars and other valuable considsrations, receipt whereof is hereby
acknowledged, hereby grants, bargains, sells, aliens, remises,
releases, conveys and confirms unto the Grantee, all that certain land
situation in St. Lucie County, Florida, viz:
Lot 130. HEATHERWOOD, St. Lucie West Plat No. 7, according to the plat
thereof, recorded in Plat Book 27, Pages 8. 8A through 8G, publi.c
records of St. Lucie County. Florida.
The land conveyed hereby is conveyed subject to the
restrictions, easements and conditions of record, and, in
particular, to the Declaration of Covenants, Conditions and
Restrictions for THE VILLAGES AT ST. LUCIE WEST ASSOCIATION,
INC. recorded in Official Record Book 618, at Page 849, as amended
in O.R. Book 628, page 1988 and to the Declaration of Covenants.
Conditions and Restrictions for ST. LUCIE WEST MASTER ASSOCIATION
recorded in O.R. Book 576 at Page 2616, as amended in O.R. Book 611, ~
page 2280; O.R. Book 619, paqe 1398; O.R. Book 619, page 1401; ~
O.R. Book 621, page 2275, O.R. Book 627, page 558, O.R. Book 628,
page 1976; and O.R. Book 634, paqe 1i06; all of the Public Records of
St. Lucie County, Florida.
This 'conveyance is made in contemplation of the formation of a
; Chapter 190, F.S., Community Development District which will
~ encompass within its boundaries the property being conveyed by this
Deed.
By acceptance of this Deed:
(1) Grantee hereby gives its full, irrevocable, and unqualified
consent to the establishment of a Community Development District,
the boundaries of which will encompass the property hereby conveyed
to Grantee by Grantor.
(2? Grantee, its heirs, successors, mortgagees, grantees or
assignees, covenant that it will execute whatever further consents,
documents, instruments, or writings as are necessary at any time
to evidence full consent and approval to the establishment of a
~ Community Development District encompassing within its boundaries the
property being conveyed by this Deed.
(3) Grantee agrees, covenants, and affirms that these
covenants run with the land and shall bind all heirs, successors,
asszgns, or subsequent grantees, mortgagees, or owners of the property
being conveyed by this Deed.
