5. MELBA M. SMITH, whose address is 4601 Georgia Avenue,
West Palm Beach, Florida, 33405 and who is qualified under the
laws of the State of Florida to serve as personal representative
of the decedent's estate is entitled to preference in appointment
as personal representative because MELBA M. SMITH is sui juris,
was a resident of Florida at the time of the death of FRED H.
SMITH, and is the person named by decedent's will as Personal
Representative and a person entitled to preference to appointment
as Personal Representative as provided under Section 733.301(1),
Florida Statntes (1987).
6. The nature and approximate value of the assets in this
Estate are real and personal property totaling less than Fifty
Thousand Dollars ($50,000.00).
7. This Estate will not be required to file a federal tax
return.
8. The original of decedent's Last Will, dated February 2,
1989, accompanies this Petition.
9. Petitioner is unaware of any unrevoked Will or codicil
of decedent other than as set forth in paragraph 8.
Petitioner requests that the decedent's Will be admitted to
probate and that MELBA M. SMITH be appointed Personal

; Representative of the Florida Estate of the decedent.
