~ MORTGAGE MODIFICATION AGREEMENT

TNI~ AGREEMENT made this lOth day of January 1990
by and between Valery Khasin and Klavdia Khasina, his wife
hereinafter called "mortgagor" and REPUBLIC SAVINGS BANK,
t~ereinafter called "mortgagee".
RECITALS:
A. MORTGAGEE is the owner and holder of that certain mortgage
(MORTGAGE) dated Auqust 18, 1989 made by the MORTGAGOR to the
MORTGAGEE recorded in Official Record~• Book 652 , Page 664
of the Public Records of St=. LuCie ; securing a debt
evidenced by a promissory note tNOTE) dated August 18, 1989
in the original amount of 7o-,000.00 , which MORTGAGE
encumbers property more pa~ticularly described in said
MORTGAGE.
8. MORTGAGOR the owner in fee simple of all of the property
sub~ect to MORTGAGE, has requested MORTGAGEE to modify the
terms thereof in the manner hereinafter appearing.
HOW, THEREFORE, in consideration of the mut~al covenants
hereinafter set forth and in consideration of the sum of TEN
DOLLARS (10.00) each to the other in hand paid and other
~ M valuable consideration the receipt and sufficiency of vhich
, is hereby acknovledged the parties hereto mutually covenant
and agree as follovs:

1. The unpaid principal balance of NOTE is 70,000.00

2. The terms and provisions of the NOTE are amended and ~
modified in accordance vith the terms and provisions of ~

3. The terms and pravisions of the MORTGAGE are amended ~

. 4. The MORTGAGER hereby reaffirms all of its obligations
E set forth in NOTE AND MORTGAGE and agrees to perform each and ,
~ all of the covenants, agreements and obligations in HOTE and
MORTGAGE and to be bound by each and all of the terms and
~ provisions of NOTE and MORTGAGE as herein modified.

S. That all of the property described in MORTGAGE, less
~ - ~ any part thereof that may have heretofore been released shall
~ in all respects be subject to the lien, charge and
~ encumbrance of MORTGAGE and nothing herein contained or done
~ shall affect the lien, charge or encumbrance affected by
~ MORTGAGE or the priority thereof over other liens, charges,
~ encumbrances or conveyances.
6. Nothing herein invalidates or shall impair or release
any covenants, condition, agreement or stipulation in NOTE
~ and MORTGAGE and the seme, except as herein modified shall
continue in full force and effect and ~the undersigned further
~ covenant and sgree to perform and comply vith end abide by
each of the covenants, agreements, conditions and
~ stipulations o~ NOTE and MORTGAGE which are not inconsistent
~
~ herewith.
