THIS AGREEMEIIT made this 29th day of DecE~nber , 1989
by and between Fima & Sofia HOnoviCh
hereinafter called "mortgagor" and REPUBLIC SAVINGS BANK,
hereinafter call'ed "mortgagee".
RECITALS:
A. MORTGAGEE is the ovner and holder of that certain mortgage
( MORTGAGE ) dated July 28, 1989 made by the MORTGAGOR to the
MORTGAGEE recorded in Official Record~• Book 650 ~ Page 111
of the Public Records of St. LuCie ; securing a debt
evidenced by a promissorj+ note ( NOTE ) dated ~7~y 28, 1989
in the original amount of $50,000.00 , vhich MORTGAGE
encumbers property more pa~rticularly described in said
MORTGAGE.
B. MORTGAGOR the owner in fee simple of all of the property
subject to MORTGAGE, has requested MORTGAGEE to modify the
terms thereof in the manner hereinafter appearing.

r+ NOW, THEREF'ORE, in consideration of the mutual covenants
M hereinafter set forth and in consideration of the sum of TEN
o M DOLLARS (10.00) each to the other in hand paid and other
o~ valuable consideration the receipt and sufficiEncy of vhich
~ is hereby acknowledged the parties hereto mutually covenant
~ o and agree as follovs:

1. The unpaid principal balance of NOTE is $50,000.00
N~~ ~ and that interest has been paid to ~ 31, 1989
2. The terms and provisions of the NOTE are amended and
modified in accordance with the terms and provisions of
v~t~.~ ~ Exhibit "A", attached hereto and incorporated herein by
~ ~ ~ a reference, entitled

3. The terms and provisions of the MORTGAGE are amended
~ and modified in accordance vith the terms and provisions of
~ Exhibit "B", attached hereto and incorporated herein by
i ~ reference, entitled

4. The MORTGAGER hereby reaffirms all of its obligations
~ set forth in TIOTE At1D MORTGAGE and agrees to perform each and
~ ~ all of the covenants, agreements and obligations in NOTE and
~ ~ MORTGAGE and to be bound by each and all of the terms and
! provisions of NOTE and MORTGAGE as herein modified.
~ 5. That all of the property described in MORTGAGE, less
~ any part thereof that may have heretofore been released shall
in all respects be subject to the lien, charge and
encumbrance of MORTGAGE and nothing herein contained or done
~ shall effect the lien, charge or encumbrance affected by
~ MORTGAGE or the priority thereof over other liens, charges,
~ encumbrances or conveyances.
€ 6. Nothing herein invalidates or shall impair or release
any covenants, condition, agreement or stipulation in NOTE
' and MORTGAGE and the seme, except as herein modified shall
continue in full force and effect and the undersigned further
covenant and agree to perform and comply vith end abide by
' each of the covenants, agreements, conditions and
