This cause coming on to be heard on the motion of the
Plaintiff, FLORIDA AGGREGATES INTERGROUP, INC., for final summary
judgment, and after hearing on sam~ and the Court being fully
advised in the premises, the Court finds and determines that
i there is no issue as to any material fact and the Plaintiff is
entitled to a judgment as a matter of law, it is thereupon
ORDERED AND ADJUUGED that pursuant to Count I of the amended
