7. Section 732.401 of the Florida Probate Code
provides that if the homestead real property is not devised as

descend in the same manner as other intestate property, but if
the decedent is survived by a spouse and lineal descendants,
the surviving spouse shall take a life estate with a vested
remainder in the lineal descendants in being at the time of the
decedent's death.

2. The decedent's hor~estead is not subject to devise,
but rather descends under Section 732.401 of the Florida
Probate Code to decedent's wife, MARY R. INFANTE, for life,
with vested remainder in decedent's only lineal decedent, MARIE
~ A. SCULL.
