THIS WARRANTY DEED made the 19th of January, 1990 by
THOS. J. WHITE DEVELOPMENT CORPORATION, a Florida corporation
(hereinafter called the "Grantor), and TOWN SQUARE DEVELOPMENT
GROUP, INC., a Florida corporaLion, whose address is 1167 N.W.
Prima Vista Boulevard, Port St. Lucie, Florida 34986,
(hereinafter called the "Grantee") tWhenever used herein, the
terms "Grantor" and "Grantee" include all the parties to this
instrument and the heirs, legal representatives and assigns of
in3ividuals, and the successors and assigns of corporations);
W I T N E S S E T H:
Grantor, for and in consideration of the sum of Ten ($10.00)
Dollars a:zd other valuable considerations, receipt whereof is
hereby acknowledged, hereby grants, bargains, sells, aliens,
remises, releases, conveys and confirms unto ~he Grantee, all
that certain land situate in St. Lucie County, Florida, viz:

The land conveyed hereby is conveyed subject to the

I~ - This Deed is made subject to the following conditions or
i restrictions which the Grantee accepts as covenants running with
f the land which inure to the benefit of and are binding on all
~ . parties, heirs, successors, assigns, subsequent grantees, owners,
~ mortgagees, or persons claiming under them:

€ _ (1) Grantee shall commence construction within twelv~ (12)
- months from the date of Closing. In the event cor,struction is
: not commenced within said period, Grantee shall reconvey the
~ property to Grantor pursuant to Paragraph 18 of the Cor.tract for
~ Sale and Purchase between Grantor and Grantee. Upon the good
~ faith commencement of construction on the Property within the
~ ~ ti~r.e period ~et forth above, the right to repurchase herein
~ ~~i~.~ provided for shall terminate and Grantor shall upon receipt of
~ written request from Grantee, execute a release of such right to
~ repurchase in recordable form. Grantor shall be entitl.ed to all
'-z T other remedies p:ovided in said Agreement.
~ R~, (2) Each building constructed snall be designed and
~ constructed in order to be connected to a gas distribution system
at the outside edg~ of said building, in full compliance with
; ' specifications promulgated by the gas company, Western Energy,
~ local, state and national regulations. Each res~_dential unit
shail be pre-piped to accommodate gas heating, hot water heaters,
stoves, and dryers. Two Hundred Dollars ($200.00) pez unit or
' residence shall be paid to Western Energy when a building permit
c is issued for gas service av3ilability and Fifty Dollars ($50.00)
3 when gas is connected for a hook-up fee.
