WARRANTY DEED
THIS WARRANTY DEED made the ~L"'~ of ~~L~ , 1990
by THOS. J. WHITE DEVELOPMENT CORPORATION, Florida corporation
(hereinafter called the "Grantor), and SOUTH FLORIDA CUSTOM HOMES,
INC., a Florida corporation, whose address is 1175 N.W. St. Lucie West
Boulevard, Port St. Lucie, Florida 34986, (hereinfter called
the "Grantee") (whenever used herein, the terms "Grantor" and
"Grantee" include ali the parties to this instrument and the
heirs, legal representatives and assigns of individuals, and the ~
successors and assigns of corporations);

Grantor, for and in consideration of the sum of Ten ($10.00) ~
DoZlars and other valuable considerations, receipt whereof is hereby '
acknawledged, hereby grani.s, bargains, sells, aliens, remises,
releases, conveys and confirms unto the Grantee, all that certain land
situated in St. Lucie County, Florida, viz:

Lot 6, PRESIDENTIAL COVE, St. Lucie West Plat No. 13, according to the
plat thereof, recorded in Plat Book 27, pages 9, 9A through 9D, public '
records of St. Lucie County, Florida. '
The land conveyed hereby is conveyed subject to the restrictions,
easements and conditions of record, and, in particular, to the
Declaration of Covenants, Conditions and Restrictions for ST. LUCIE
WEST COUNTRY CLUB ESTATES ASSOCIATION, INC. recorded in O.R. Book
573 at Page 1941, as amended in O.R. Book 619, page 1395; O.R. Hook
' 621, page 2282; O.R. Book 627, page 563; and O.R. Book 628, page
1981; and to the Declaration of Covenants, Conditions and Restrictions
for ST. LUCIE WEST MASTER ASSOCIATION recorded in O. R. Book 576 at
Page 2616, as amended in O.R. Book bll, page 2280; O.R. Book 619, page
1398; O.R. Book 619, page 1401, O.R. Book 621, page 2275, O.R. Book
627, page 558; O.R. Book 628, page 1976; O.R. Book 634, page 1106; and
O.R. Book 649, page 1359; all of the Public Records of St. Lucie
County, Florida.
SUBJECT TO all of its exhibits, reservations, rights-of-way,
limitations of recard, zoning and other prohibitions imposed by
; governmental authority and real property taxes subsequent to Dzcember
~ 31, 1989.

~ This Deed is made subject to the following conditions or
restrictions which the Grantee accepts as covenants running with the
land which inure to the benefit of and are binding on all parties,
~ heirs, successors, assigns, subsequent grantees owners, mortgagees, or
~
~ persons claiming under them:
' (1) Grantee shall commence construction within twelve (12) months
~ from the date of Closing. In the event construction is not commenced
~ within said period, Grantee shall reconvey the property to Grantor
~ gursuant to Paragraph 13 of the Participating Builder Lot Sales
~ Agreement between Grantor and ~rantee. Grantor shall be entitled to
~ all other remeciies provided in said Agreement.

~ (2) Each residenc~ constructed shall be designed and constructed in
~ order to be cennected to a gas distrihution system at the outside edge
~ of said building, ~n full compliance with specifications promulgated by
the gas company, Western Energy, local, state and national regulations.
Each residential unit shall be pre-piped to accommodate gas heating,
hot water heaters, stoves and dryers. Two Hundred Dollars ($200.00)
per unit or residence shall be paid to Western Energy when a building
permit is issued for gas service availability and Fifty Dollars
($50.00) when gas is connected for a hook-up fee.

~ {3) With each residence constructed, Grantee shall, at Grantee's
~ expense, fully wire the premises for complete connection to private
~ cable television services for not less than four (4) cable television
