KNOW ALL MEN BY THESE PRESENTS: ~

WHEREAS THE TORONTO-DOMINION BANR, a bank chartered under
the Bank Act of Canada, havinq its principal office in the City
of Atlanta, State of Georgia (hereinafter referred to as
"Mo~tgaqeep), is the owner and holder of the followinq
Mortqaqe:
Mortgage from WESTON-FLORIDA DEVELOPI~€ENT CORPORATION
- FT. PIERCE #I, WESTON-FLORIDA DEVELOPMENT - FT.
PIERCE #II, and WESTON-FLORIDA DEVELOPMENT
CORPORATION - FT. PIERCE #III, all Florida
Corporations (collectively hereinafter called
"Mortgaqor"), to Mortgagee dated November 3, 1981,
and recorded November 10, 1981, in Official Records
Book 366, Paqe 887, Public Records of St. Lucie
County, Florida, securing the original principal sum
of Twelve Million Five Hundred Thousand and No/100
Dollars U.S. ($12,500,000.00), as amended by that
certain Future Advance Aqreement and Modification of
Mortqage and Note, between Mortqagor and Mortgagee~
dated February 7, 1984, and recorded on ADril
1984, in Official Records Book 430, Page 1418, as
modified by Future Advance Agreement and Modification
recorded on September 7, 1994, in Official Records
Book 442, Paqe 1662, further modified by Modification
Agreement recorded on April 1, 1987, in Official
Records Book 536, Page 2914, ALL being of the Public
Records of St. Lucie County, Florida, (collectively
hereinafter called the "Mortgage").
WHEREAS, the said Mortgagor has requested the Mortgagee to
release the premises hereinafter described, beinq part of said
mortgaged premises, from the lien and operation of said
Mortqage.
I NOW THEREFORE, RNOW YE, that said Mortgagee, in
~ consideration of the premises and of the sum of Ten and No/100
; Dollars ($10.00) to it in hand paid, or in behalf of, the said
; Mortgagor at the time of the execution hereof, the receipt
; whereof is hereby acknowledged, does remise, release, quit-
; claim, exonerate and discharge from the lien and operation of
€ said Mortqaqe unto the said Mortgagor, its successors and
" assigns, that certain portion of the premises conveyed by said
s Mortgag4r more particularly described as follows:

s Condominium Dwelling Unit PH-202, of SEA POINTE
~ TOWERS OF FORT PIERCE, a Condominium, according to
~ the Declaration of Condominium thereof as recorded in
° Official Records Book 435, Page 1463, et seq., and as
~ corrected by Corrective Declaration as recorded in
~ Official Records Book 536, Page 2768, et seq., Public
Records of St. Lucie County, Florida, toqether with
~ all of the agpurtenances thereto, as set forth in
~ said Declaration and Corrective Declaration of
~ Condominium. TOGETHER WITH its undivided interest in
~ the common elements appurtenant thereto.
TO HAVE AND TO HOLD the same with the appurtenances unto
the said Mortqagor, its successors and assigr~s forever, freed,
exonerated and discharged of and from the lien of the said
Mortqage, and every part thereof; provided always nevertheless
that nothing herein contained shall in anywi~e impair, alter,
i or diminish the effect, lien or encumbrance of the aforesaid
Mortgage on the remaining portion of the mortgaqed premises
~ thereunder not hereby released or any of the rights and
~ remedies of the holders thereof.

E This instrument also releases the hereinabove-described
u property from the lien and operatic~n of the followinq documents
~ and any and all other security instruments that the lender may
~ hold as of this date encumberinq the property:
